Terms of Service & SMS Program

Acceptance of Terms

By accessing or using the TalkEnsure website at talkensure.com, the AI platform at ai.talkensure.com, or any related services, mobile applications, or SMS communications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.

If you do not agree to these Terms, please discontinue use of the Services immediately. These Terms constitute a legally binding agreement between you and TalkEnsure ("Company," "we," "us," or "our").

We reserve the right to update these Terms at any time. We will notify you of significant changes by posting an updated version on our website with a new effective date. Your continued use of the Services after any update constitutes your acceptance of the revised Terms.

Section 2

Our Services

TalkEnsure provides an online platform and AI-powered advisory service that:

  • Provides general educational information about life insurance, health insurance, and Medicare products
  • Connects consumers with licensed, independent insurance professionals
  • Operates an AI-powered advisor ("Ava") that answers insurance-related questions and facilitates referrals
  • Collects consumer information to match individuals with appropriate licensed agents
  • Sends SMS text messages for appointment reminders, follow-up communications, and service notifications

Talk Ensure is a marketing and lead generation platform โ€” we are not a licensed insurance carrier, underwriter, or guarantor of any insurance product. All insurance products are offered, underwritten, and administered by independent, licensed third-party insurance carriers and agents.

Section 3

Eligibility

To use our Services you must:

  • Be at least 18 years of age
  • Be a legal resident of the United States
  • Provide accurate, current, and complete information when requested
  • Have the legal capacity to enter into a binding contract

By using our Services, you represent and warrant that you meet all eligibility requirements. TalkEnsure reserves the right to refuse service to anyone for any reason not prohibited by law.

TalkEnsure SMS Program

Program Description

By providing your mobile phone number and submitting a form on TalkEnsure.com or ai.talkensure.com, you expressly consent to receive recurring automated SMS text messages from TalkEnsure and/or its licensed agent partners regarding:

  • Insurance quotes, product information, and plan comparisons
  • Appointment scheduling and callback confirmations
  • Follow-up communications from your assigned licensed agent
  • Important service notifications and account updates
  • Educational content about insurance and Medicare

Message Frequency

Message frequency varies. You may receive up to 6 messages per month from TalkEnsure. Individual licensed agents may also contact you separately based on your consent. Message and data rates may apply depending on your mobile carrier and plan.

How to Opt Out (STOP)

You may opt out of TalkEnsure SMS communications at any time by replying STOP to any text message you receive from us. After opting out, you will receive a single confirmation message and no further SMS messages will be sent. To opt back in, text START to the same number.

Help

For help, reply HELP to any TalkEnsure SMS, or contact us at the information listed in Section 12 of these Terms. For MMS Messaging support, contact your wireless carrier.

Supported Carriers

TalkEnsure SMS is available on all major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, MetroPCS, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages.

No Purchase Required

Consent to receive SMS messages is not a condition of purchasing any insurance product or using any of our services. You may request information and speak with a licensed agent without providing your phone number or consenting to SMS communications.

Privacy of Your Phone Number

Your mobile phone number will not be sold or transferred to third parties for their own marketing purposes without your explicit consent. It may be shared with your specifically assigned licensed agent for the purpose of fulfilling the insurance consultation you requested. See our Privacy Policy for complete details.

Section 5

AI Advisor โ€” Ava

TalkEnsure operates an artificial intelligence-powered advisor called "Ava" on the ai.talkensure.com platform. By using Ava, you acknowledge and agree to the following:

  • Ava is not a licensed insurance agent or financial advisor. Ava provides general educational information and guidance only.
  • Responses from Ava do not constitute personalized financial, legal, or insurance advice.
  • Ava may make errors or provide incomplete information. Always verify information with a licensed professional.
  • Conversations with Ava may be recorded and reviewed for quality assurance and service improvement purposes.
  • Do not share sensitive personal information such as Social Security numbers, banking credentials, or medical records with Ava unless specifically prompted as part of a secured application process.
  • Ava's availability is subject to maintenance, updates, and service interruptions.

The 6-digit PIN system used by Talk Ensure is designed to help verify agent identity before calls. While we take reasonable measures to protect your privacy, TalkEnsure cannot guarantee that all agent communications will use this system.

Section 6

Privacy & Data Collection

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By submitting your information through any form on our Services, you consent to:

  • Being contacted by TalkEnsure and its licensed agent partners via phone, email, and SMS
  • Your information being shared with licensed insurance agents for the purpose of providing quotes
  • The use of your information to match you with appropriate insurance products
  • Storage of your information in our secure database systems

You may request deletion of your personal information at any time by contacting us. See our Privacy Policy for complete details about your rights under applicable state privacy laws including CCPA (California) and other state regulations.

Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TALKENSURE DISCLAIMS ALL WARRANTIES INCLUDING:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • That the Services will be uninterrupted, error-free, or secure
  • The accuracy, completeness, or timeliness of any information provided through the Services
  • That results obtained from the Services will be accurate or reliable

Insurance Coverage Disclaimer: TalkEnsure does not guarantee that any individual will qualify for, be approved for, or receive any insurance coverage. All approvals are subject to underwriting by the applicable insurance carrier. Premium quotes are estimates and may vary based on full underwriting review.

Section 8

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TALKENSURE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Services
  • Any insurance coverage decisions made based on information from our Services
  • Unauthorized access to or alteration of your data
  • Actions of any third-party insurance agents or carriers
  • Any other matter relating to the Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Intellectual Property

All content on the TalkEnsure Services โ€” including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software โ€” is the property of TalkEnsure or its content suppliers and is protected by United States and international copyright laws.

The TalkEnsure name, the Ensure logo, "Ava" AI advisor name, and all related marks, logos, and service names are trademarks of TalkEnsure. You may not use these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our Services.

Section 10

Termination

TalkEnsure reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Providing false or misleading information
  • Any conduct that TalkEnsure determines to be harmful to other users, third parties, or the Services

You may discontinue use of the Services at any time. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Section 11

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Talk Ensure is domiciled, without regard to its conflict of law provisions.

Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered in accordance with the American Arbitration Association Commercial Arbitration Rules. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction for matters involving intellectual property rights or irreparable harm.
